Manhattan judge orders $889m forfeiture after jury fraud conviction

Guo Wengui, a self-exiled Chinese businessman also known as Miles Guo and Ho Wan Kwok, was sentenced on Monday to 30 years in a United States prison after a federal judge in Manhattan said his financial fraud cost more than 1,000 people worldwide hundreds of millions of dollars.

The sentence is among the most severe in a recent US fraud case involving overseas political fundraising and investment pitches, with the court citing widespread losses among supporters who believed they were backing pro-democracy efforts related to China. Key developments

  • US District Judge Analisa Torres sentenced Guo to 30 years in prison in Manhattan.

  • The judge ordered Guo to forfeit $889m.

  • A jury unanimously found Guo guilty in 2024 of fraud, various securities offences, wire fraud and money laundering.

  • At sentencing, Torres said Guo “preyed on those seeking to bring Democracy to China” and used their money to support a lavish lifestyle.

  • Prosecutors sought a sentence of at least 30 years, arguing Guo’s fraud from 2018 to 2023 “destroyed hundreds of lives”.

Context and background

Guo made his fortune in real estate and moved to the United States in 2015 after fleeing China. Over the past decade, he recast himself in the US as a critic of the Chinese Communist Party (CCP) and was based in New York.

He also maintained ties with US right-wing figure Steve Bannon. Guo and Bannon formed a lobbying group opposed to the CCP called the New Federal State of China.

Details and evidence

The FBI arrested Guo in 2023 in his luxury Manhattan apartment overlooking Central Park.

During Monday’s hearing, Guo complained about his health and addressed the criminal case only briefly, saying he came to the United States “to destroy” the CCP.

Torres read excerpts from letters she received from victims, who described losing life savings and feeling anxious and shamed, and said some faced backlash from family members over their investment decisions.

The judge said Guo accepted no responsibility for his actions and “instead insists, incredibly, his conduct caused no loss and harmed no one”.

Wei Chen, a victim who testified at trial, told the court that Guo’s fraud “destroyed my life” and that of her family.

In court filings, Guo’s lawyers argued he was the target of a “grand, pervasive, and life-threatening” pursuit by the CCP, and said a lengthy prison term would validate what they described as a Chinese smear campaign and “embolden further efforts to eliminate Chinese dissidents from public life”.

Current status and next steps

Guo has been sentenced to serve 30 years in prison and ordered to forfeit $889m. No additional information was provided about any appeal plans or further court proceedings.

Separately, Bannon was arrested in 2020 on Guo’s yacht in a case involving the embezzlement of funds tied to a US border wall project on the Mexico frontier, connected to a major pledge from US President Donald Trump’s 2016 presidential campaign.
